Welcome to NextGen Cloud Academy ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our website, courses, and services. By enrolling in our programs or using our website, you agree to these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By accessing or using any of our services, you agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users, including parents or guardians enrolling children in our courses.
2. Eligibility
Our courses are designed for children aged 10 to 15. Parents or legal guardians must register on behalf of their children and ensure compliance with these Terms. Users must reside in Canada to enroll in our in-person programs. All users are required to bring their own laptop for use in class.
3. Registration and Payment
- Enrollment: To enroll in our courses, parents or guardians must complete the registration form and submit payment through our website or designated channels.
- Fees: All fees are listed on our website and are subject to change. Payment is required in full prior to the start of each term.
- Pilot Program Deposit: Our free pilot class requires a CAD $50 deposit. This deposit is non-refundable unless the student subsequently enrolls in a full course from our catalog launching in Fall 2025. If the student enrolls in a full course within 6 months of completing the pilot class, the $50 deposit will be applied as a credit toward the cost of that course. If we need to cancel a pilot class due to insufficient enrollment or other circumstances beyond our control, the deposit will be refunded in full or can be applied to a future pilot class at the parent/guardian's discretion.
- Refunds: Refunds for regular courses are only available if cancellation occurs at least 7 days before the course begins. A $40 registration fee is non-refundable. The $50 pilot program deposit is only refundable as a credit toward a future full course enrollment as described above.
- Class Scheduling and Cancellation: We reserve the right to reschedule classes if necessary. We will provide at least 48 hours notice except in emergency situations. If a class is canceled by NextGen Cloud Academy, a make-up session will be scheduled. Students who miss a class are not entitled to a refund or make-up session unless arranged at least 48 hours in advance, subject to availability.
- Minimum Enrollment Requirements: Our courses require a minimum number of enrolled students to proceed as scheduled. We reserve the right to cancel any course that does not meet the minimum enrollment requirements. In such cases, we will provide enrolled students with the following options:
- Full refund of all course fees paid (including the registration fee)
- Transfer to another available course (subject to availability)
- Credit toward a future course
- Schedule Changes: Course times, dates, and locations are subject to change prior to the start of the term. While we strive to maintain the published schedule, we reserve the right to:
- Modify course start and end dates
- Adjust meeting times
- Change venue locations
- Alter course format (in-person, online, or hybrid)
4. Course Materials and Conduct
- Materials: Students will receive access to course materials and AI tools as part of their enrollment. All materials are for personal, educational use only.
- Behavior: Students are expected to maintain respectful behavior during classes. Disruptive or inappropriate behavior may result in removal from the program without a refund.
- Technology Requirements: As noted in the Eligibility section, students must bring their own laptop to class. Minimum system requirements include: a laptop capable of connecting to Wi-Fi, running a modern web browser (Chrome, Firefox, Safari, or Edge), with at least 4GB RAM and 1GB of free storage space. NextGen Cloud Academy is not responsible for technical issues related to personal devices, though our instructors will provide reasonable assistance when possible.
- Parental Responsibility: Parents/guardians accept responsibility for their child's actions during class, including online interactions when using AI tools. Parents/guardians must ensure their child understands appropriate online behavior and use of AI technologies in accordance with the instructor's guidance.
- Course Prerequisites: It is required that all students complete the GenAI Fundamentals course before progressing to other courses. This is to ensure that students have the prerequisite skills to benefit from follow-on classes that rely on fundamental concepts. No exceptions will be made to this requirement unless the student can demonstrate equivalent knowledge and experience to the satisfaction of NextGen Cloud Academy.
5. Intellectual Property
All course content, including curriculum, tools, and materials, is the intellectual property of NextGen Cloud Academy. Reproduction, distribution, or commercial use of any content without written permission is strictly prohibited.
6. Limitation of Liability
We are not responsible for any technical issues, delays, or interruptions caused by third-party platforms (e.g., ChatGPT, Claude, Midjourney). While we strive to provide a seamless learning experience, we make no guarantees regarding uninterrupted access to AI tools or platforms.
To the maximum extent permitted by applicable law, NextGen Cloud Academy, its directors, employees, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
NextGen Cloud Academy does not guarantee specific outcomes or results from participation in our courses. Learning outcomes may vary based on student participation, comprehension, and practice.
Parents/guardians acknowledge that participation in in-person classes carries inherent risks. While we take reasonable precautions to create a safe learning environment, NextGen Cloud Academy is not liable for minor injuries that may occur during normal class activities.
7. Privacy
We respect your privacy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Since our services are directed at children under 16 years of age, we take special care in collecting and handling personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy laws in Canada. We collect only the minimum information necessary to provide our services, and we obtain verifiable parental consent before collecting personal information from children. Parents/guardians have the right to review their child's personal information, request its deletion, and refuse further collection or use of the child's information.
By enrolling in our courses, you consent to receive electronic communications from NextGen Cloud Academy regarding administrative matters, course information, updates, and promotional information related to our services. You may opt out of promotional communications while continuing to receive essential administrative communications.
8. Termination Rights
NextGen Cloud Academy reserves the right to terminate or suspend services to any student for violations of these Terms, including but not limited to disruptive behavior, inappropriate use of AI tools, or failure to comply with instructor directions. If termination occurs due to violation of these Terms, no refund will be provided. If termination occurs for reasons not related to violations of these Terms, a prorated refund may be provided at our discretion.
9. Media Release
During classes, NextGen Cloud Academy may take photographs or video recordings for promotional, educational, or archival purposes. By enrolling in our courses, parents/guardians grant permission for their child's image to be used in promotional materials, social media, website content, and other marketing materials. If you wish to opt out of this media release, please notify us in writing at info@nextgencloudacademy.com.
10. Indemnification
You agree to indemnify, defend, and hold harmless NextGen Cloud Academy, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to our services; (ii) your violation of any of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
11. Changes to Terms
We reserve the right to update these Terms at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Ontario, Canada. Any disputes arising from these Terms will be resolved in the courts of Toronto, Ontario. Before pursuing formal legal action, we encourage users to first attempt to resolve any disputes through direct communication with NextGen Cloud Academy by contacting us at info@nextgencloudacademy.com.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
